Canadian Human Rights Tribunal

As of today’s date, the following categories of people are each entitled to $40,000:

  • First Nations children living on reserve and in the Yukon who were removed from their home unnecessarily and placed in the child welfare system between the years of 2006 and 2019.
  • First Nations children living on reserve and in the Yukon who, as a result of suffering abuse at home, were necessarily taken from their homes but placed in care outside of their extended families and communities between the years of 2006 and 2019.
  • Each parent or grandparent caring for a First Nations child living on reserve and in the Yukon who was removed from their home unnecessarily and placed in the child welfare system between the years of 2006 and 2019, if those parents or grandparents did not sexually, physically or psychologically abuse the child.
  • First Nations children living on reserve or off reserve who were removed from their homes, families and communities and placed in care in order to access health or social services between December 12, 2007 and November 2, 2017.
  • First Nations children living on reserve or off reserve who were not removed from their homes but were denied services or received services after an unreasonable delay or upon reconsideration ordered by the Tribunal, between December 12, 2007 and November 2, 2017.
  • Each parent or grandparent of a First Nations child living on reserve or off reserve who, as a result of a gap, delay and/or denial of services were deprived of essential services for their child/grandchild, or had their child/grandchild placed in care outside of their homes, families and communities in order to receive those services, and therefore did not benefit from services covered under Jordan’s Principle, if those parents or grandparents did not sexually, physically or psychologically abuse the child.

$40,000 per person is the maximum combined amount that the Tribunal is allowed to award under subsections 53(2)(e) and 53(3) of the Canada Human Rights Act. Please contact us for more information about your $40,000.

Ongoing Class Action

A class action has been filed by Sotos Class Actions, Kugler Kandestin LLP and Miller Titerle + Company to obtain compensation for First Nations children and families who suffered from Canada’s discrimination from 1991 to 2019.
